Welcome to the website and e-shop visionarypaint.art (“Website”, “E-shop”, “Services”), operated by XTREAM a.s. (“XTREAM”, “we”, “us”, “our”).

These Terms of Use and Terms and Conditions (“Terms”) govern the use of the visionarypaint.art website, the purchase of products, participation in online auctions (if available), and all related services.

The Website is technically operated on the Shopify platform. However, all contractual relationships arise exclusively between you and XTREAM a.s.

By using the Website, placing an order, or participating in an auction, you confirm that you have read, understood, and agree to these Terms.

1. ACCESS AND USER ACCOUNT

1.1 By using the Services, you confirm that:

  • you are at least 18 years old or of legal age according to the laws of your country of residence,
  • you have the capacity to enter into legally binding contracts.

1.2 When making a purchase or participating in an auction, you may be required to create a user account. You agree to:

  • provide true, current, and complete information,
  • protect your login credentials,
  • notify us immediately of any suspected misuse of your account.

1.3 The account is non-transferable.

2. PRODUCTS AND SERVICES

2.1 Through visionarypaint.art, XTREAM a.s. offers artworks, visual art, and other products or services according to the current offer.

2.2 We strive to present products as accurately as possible (photos, descriptions, visualizations); however:

  • colors may vary depending on device settings,
  • minor variations in handmade creations are a natural characteristic of original works.

2.3 We reserve the right to:

  • change the description, availability, or price of a product,
  • discontinue the sale of a specific product,
  • limit the quantity per customer or per order.

3. ORDERS

3.1 By submitting an order, you are making an offer to enter into a purchase agreement.

3.2 A purchase agreement is formed at the moment the order is confirmed by email or upon receipt of payment.

3.3 XTREAM a.s. reserves the right to refuse or cancel an order, particularly in the event of:

  • an obvious error in price,
  • unavailability of the product,
  • suspicion of fraudulent activity.

4. ONLINE AUCTIONS (IF AVAILABLE)

4.1 Some products may be offered via online auction.

4.2 A bid represents a binding offer to purchase at that price.

4.3 The auction winner is obliged to pay the price within the specified period.

4.4 XTREAM a.s. reserves the right to cancel or modify an auction in the event of a technical error or system abuse.

5. PRICES AND PAYMENTS

5.1 Prices are stated in the currency selected for the given market (typically EUR).

5.2 XTREAM a.s. is not a VAT payer, unless otherwise determined by legal regulations.

5.3 Prices do not include shipping costs or other fees unless otherwise stated.

5.4 Payments are processed through payment methods supported by the Shopify platform.

6. SHIPPING AND DELIVERY

6.1 Shipping methods, estimated delivery times, and prices are specified during the ordering process.

6.2 Delivery times are approximate.

6.3 The risk of damage or loss passes to the customer at the moment of receipt of the goods.

7. WITHDRAWAL FROM THE CONTRACT AND CLAIMS

7.1 If you are a consumer, you have the right to withdraw from a distance contract within 14 days without giving any reason, unless the law provides otherwise.

7.2 The right of withdrawal does not apply to:

  • goods made to order,
  • goods customized according to individual requirements,
  • cases specified by legal regulations.

7.3 Claims and complaints are governed by the laws of the Slovak Republic.

8. INTELLECTUAL PROPERTY

All content on the visionarypaint.art website (texts, photographs, graphics, design, XTREAM logo, and other designations) is protected by intellectual property rights.

This content may not be used for commercial purposes without the prior written consent of XTREAM a.s.

9. PRIVACY POLICY

The processing of personal data is governed by the Privacy Policy document available on visionarypaint.art.

10. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Slovak Republic.

Disputes will be resolved by the competent court of the Slovak Republic according to the registered office of XTREAM a.s.

If you are a consumer, you also have the right to contact an alternative dispute resolution body in accordance with applicable legislation.
